Who we are: Candid Property Pty Ltd (ABN: 91 682 820 471). Licence No. 4866990. We respect your privacy. This Policy explains how we collect, use, disclose and protect personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1) About these terms

1.1 These Terms of Use apply to your use of the website at candidproperty.com.au, including every page, blog article, guide, checklist, form and download on it (the Website).

1.2 The Website is owned and operated by Candid Property Pty Ltd (ABN 91 682 820 471). In these Terms, "Candid Property", "we", "us" and "our" mean Candid Property Pty Ltd. "You" and "your" mean the person using the Website.

1.3 By using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

1.4 These Terms cover the use of the Website only. If you engage us as your buyer's agent, that engagement will be governed by a separate written agreement signed by you and us. If that agreement and these Terms ever conflict, the signed agreement will prevail.

2) Who may use the website

2.1 The Website and our services are intended for people aged 18 years or over. By submitting your details through the Website, you confirm that you are at least 18 years old.

2.2 If you are under 18, you may browse the Website with the involvement of a parent or guardian, but you must not submit your personal details to us.

3) What the website does

3.1 The Website provides general information about Candid Property, our buyer's agency services and the Queensland property market. It includes blog articles and free downloadable resources such as our First Home Buyer Guide and Pre-Settlement Inspection Checklist (Resources).

3.2 You may ask us to send you a Resource, or to contact you, by completing a form on the Website. You do not need to create an account, and no products or services can be bought through the Website.

3.3 We may change, suspend or remove any part of the Website or any Resource at any time without notice. We do not promise that the Website will always be available, uninterrupted or free of errors, viruses or other harmful code.

4) General information only

4.1 Everything on the Website, including the Resources, is general information only. It has been prepared without taking into account your objectives, financial situation or needs. It is not a substitute for advice about your own circumstances.

4.2 Not financial, credit, tax or legal advice. Candid Property is a licensed real estate agency operating as a buyer's agent. We do not hold an Australian Financial Services Licence or an Australian Credit Licence. Nothing on the Website is financial product advice, credit assistance, tax advice or legal advice. We may suggest lenders or mortgage brokers you could approach, but we do not recommend any particular loan, credit product or financial product, and we do not help you apply for one. Whether a loan suits you is a matter for you, your lender and, if you choose, a licensed mortgage broker.

4.3 Lenders under the Defence Home Ownership Assistance Scheme. A DHOAS subsidy is only available on a loan from one of the lenders appointed to the scheme's panel by the Australian Government. We have no role in choosing those lenders. Where we mention the panel lenders, we are passing on a fact about how the scheme works, not recommending any one of them. The choice of lender and loan is yours, and you should compare the panel lenders' products yourself or with a licensed mortgage broker.

4.4 Independent advice. Before you make any decision about buying property, borrowing money, structuring a purchase or claiming a tax benefit, you should obtain advice from an appropriately qualified and licensed professional, such as a solicitor, conveyancer, accountant, financial adviser or mortgage broker.

4.5 Defence and government entitlements. The Website may refer to Defence and government housing schemes and grants, including the Defence Home Ownership Assistance Scheme (DHOAS), the Home Purchase Assistance Scheme (HPAS), the First Home Owner Grant and other first home buyer concessions. Eligibility rules, amounts and conditions for these schemes are set and changed by the relevant government bodies, and they depend on your personal circumstances. Any information on the Website about these schemes is general only. You must confirm your eligibility and entitlements directly with the Department of Defence, Defence Housing Australia, the Queensland Revenue Office or the relevant scheme administrator before you rely on them.

4.6 Market information, estimates and forecasts. The Website may contain market data, suburb commentary, sales results, rental yields, examples and opinions about future market conditions. This material is based on information available to us when it was published and may be drawn from third-party sources we have not independently verified. Property values and rents can fall as well as rise. Past results and examples do not guarantee future outcomes, and we do not guarantee any capital growth, rental return, purchase price or other result.

4.7 Accuracy. We take reasonable care to keep the Website accurate and current. However, laws, lending policies, government schemes and market conditions change often, and some content may be out of date by the time you read it. The date shown on an article or Resource is the date it was prepared or last reviewed.

5) Your responsibilities

5.1 When you use the Website, you agree to:

(a) use it only for lawful purposes and in line with these Terms

(b) give us information that is true, accurate and your own when you complete a form

(c) not submit another person's details without their permission.

5.2 You must not:

(a) copy, scrape, harvest or collect content or data from the Website by automated means, including bots, crawlers or scripts, without our written permission

(b) attempt to gain unauthorised access to the Website, its servers or any connected system or database

(c) introduce viruses, malware or any other harmful code, or interfere with the proper working of the Website

(d) use the Website or its forms to send spam, unsolicited advertising or misleading information

(e) impersonate any person, or misrepresent your connection with any person or organisation

(f) use the Website in a way that infringes the rights of any other person or breaches any law

(g) frame, mirror or reproduce any part of the Website on another website without our written permission.

6) Intellectual property

6.1 Unless otherwise stated, we own, or hold a licence to use, all intellectual property in the Website and the Resources. This includes text, articles, guides, checklists, graphics, logos, photographs, videos, the "Candid Property" name and our tagline.

6.2 You may view the Website and download, print and keep a copy of the Resources for your own personal, non-commercial use. You must keep any copyright or ownership notices on them.

6.3 You must not otherwise copy, reproduce, republish, sell, distribute, adapt or commercially use any material from the Website without our prior written permission, except as permitted by the Copyright Act 1968 (Cth).

6.4 You may share a link to a page on the Website, provided you do so fairly and do not suggest any endorsement or connection that does not exist.

6.5 Nothing in these Terms transfers any of our intellectual property rights to you.

7) Third-party links, services and referrals

7.1 The Website may contain links to websites, tools and social media pages operated by others, including government agencies, lenders, property portals, Facebook and Instagram. We provide these links for convenience only. We do not control those websites and are not responsible for their content, availability or privacy practices. A link does not mean we endorse the website or its operator.

7.2 The Website may use third-party services to operate forms, store enquiries, send emails and measure how the Website is used. Your use of those features may also be subject to the terms of those providers.

7.3 If we refer you to another professional, such as a solicitor, conveyancer, mortgage broker or building and pest inspector, that professional is independent of us and is responsible for their own services. We do not charge you for a referral, and no one pays us simply for passing on your details. Some professionals, including some lenders and mortgage brokers, may pay us if you engage them and your matter is successfully completed, for example when your loan proceeds. Where this applies, we will tell you before we make the referral, and we will pass on your details only with your permission.

8) Privacy and communications

8.1 We collect, use, store and disclose personal information in line with our Privacy Policy, available on the Website. By submitting a form, you acknowledge that you have read our Privacy Policy.

8.2 Our Privacy Policy explains, among other things:

(a) that the details you give us through the Website are held in our customer relationship management system and other business platforms, which may store or process data overseas, principally in the United States

(b) how we use artificial intelligence tools in our business and the limits we place on that use

(c) how long we keep personal information and how we securely destroy or de-identify it when it is no longer needed.

Please read it before you submit your details.

8.3 When you request a Resource or submit an enquiry, you agree that we may contact you by email, phone or SMS about your request and about our services. Every marketing email we send will include a way to unsubscribe, and you can opt out at any time by using that link or by emailing [email protected].

9) Reviews and testimonials

9.1 Any client reviews or testimonials on the Website reflect the genuine experience of the individual client concerned. Every property purchase is different, and a result achieved for one client does not mean you will achieve the same or a similar result.

10) Your rights under the Australian Consumer Law

10.1 Nothing in these Terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or changed.

10.2 Clauses 11, 12 and 13 apply only to the extent permitted by law, and each of them is subject to this clause 10.

11) Disclaimer

11.1 The Website and the Resources are provided free of charge, on an "as is" and "as available" basis.

11.2 To the extent permitted by law, we exclude all representations, warranties and guarantees about the Website and the Resources that are not expressly stated in these Terms. This includes any implied warranty that the content is accurate, complete, current or suitable for any particular purpose.

11.3 You are responsible for making your own enquiries and obtaining independent advice before acting on any information on the Website.

12) Limitation of liability

12.1 To the extent permitted by law, we are not liable to you for any loss or damage, whether direct, indirect or consequential, and whether arising in contract, negligence or otherwise, that results from:

(a) your use of, or inability to use, the Website

(b) your reliance on any information on the Website or in any Resource

(c) any error, omission, delay or interruption on the Website

(d) any virus or harmful code transmitted through the Website

(e) any third-party website, service or professional referred to on the Website.

12.2 Where our liability for failing to comply with a consumer guarantee cannot be excluded but can be limited, our liability is limited, at our option, to supplying the relevant service again or paying the cost of having it supplied again.

12.3 Nothing in these Terms limits our liability for fraud, or for death or personal injury caused by our negligence.

13) Indemnity

13.1 You agree to indemnify us against any claim, loss, damage, cost or expense, including reasonable legal costs, that we suffer or incur as a direct result of:

(a) your breach of clause 5 of these Terms

(b) your infringement of any intellectual property right or other right of a third party in connection with your use of the Website.

13.2 Your liability under clause 13.1 is reduced to the extent that the claim, loss, damage, cost or expense was caused or contributed to by our own negligence, breach or wrongful act.

14) Suspending or ending access

14.1 We may restrict, suspend or block your access to all or part of the Website at any time, without notice, if we reasonably believe you have breached these Terms or are using the Website unlawfully or in a way that could harm us, the Website or other users.

14.2 You may stop using the Website at any time. Clauses 6, 10, 11, 12, 13 and 16 continue to apply after you stop using the Website.

15) Changes to these terms

15.1 We may update these Terms from time to time, for example to reflect changes in the law, our services or the way the Website works. The updated Terms will be posted on this page with a new effective date.

15.2 Changes apply from the date they are posted and do not apply to anything that happened before that date. Your continued use of the Website after that date means you accept the updated Terms. We encourage you to check this page from time to time.

16) Governing law and disputes

16.1 These Terms are governed by the laws of Queensland, Australia.

16.2 If you have a concern or dispute about the Website or these Terms, please contact us first using the details in clause 18. We will try in good faith to resolve the matter with you within 30 days of receiving your written notice.

16.3 If the matter cannot be resolved in that time, either party may take it to a court or tribunal of competent jurisdiction. You and we each agree to submit to the non-exclusive jurisdiction of the courts and tribunals of Queensland, and any courts that can hear appeals from them.

16.4 Nothing in this clause stops either party from seeking urgent relief from a court, or stops you from making a complaint to a consumer protection agency, the Office of Fair Trading Queensland or any other regulator.

17) General

17.1 If any part of these Terms is found to be invalid or unenforceable, that part will be read down to the extent necessary, or removed if it cannot be read down, and the rest of these Terms will continue to apply.

17.2 If we do not enforce any part of these Terms straight away, that does not mean we have given up our right to do so later.

17.3 These Terms, together with our Privacy Policy, form the entire agreement between you and us about your use of the Website.
